In a supplemental needs trust a trustee controls the management of the funds. The funds cannot be directed or controlled by the primary beneficiary. The trustee does have a fiduciary obligation to the primary beneficiary.
By putting a supplemental needs trust in place for a disabled person or person with disabilities, we're ensuring that monies given to them will not supplant their public benefits but merely supplement what they need. In addition, if we were to leave the money outright to them, they would likely lose their benefits or have a significant interruption with their benefits. This way, we can leave the disabled person or the person with disabilities with assets that can be used for their benefit and also providing for residuary beneficiaries in the event that they predecease the balance of the account.
